Terms of Service

Effective date: November 23, 2025

This service agreement is a legal contract between you (the client) and Majestic Booth NZ (“we” or “Provider”). By booking of using our services, you agree to be bound by these terms, unless a separate written agreement is signed.

Service Delivery and Setup

 

1.1 The setup time is 1 hour prior to the scheduled rental period, with packdown occurring 30 minutes once rental time has ended.

1.2 Please note that any time spent on setup and packdown is outside of the rental hours.

1.3 Occasionally, maintenance or troubleshooting may be required during the event, which may affect the photobooth's operation to an estimated uptime of 80%.

1.4 If early setup is required more than 60 minutes before the scheduled start, an additional fee of $50 per hour for idle time will be applicable.

 

Payment Terms

 

2.1 A non-refundable deposit of 30% of the total booking fee is required to secure the reservation.

2.2 The remaining balance must be paid in full 7 days before the event date.

2.3 Additional charges may apply for extra hours at a predetermined rate, which must be agreed upon prior to the event.

2.4 The client shall be responsible for all costs, including legal and collection fees, incurred by the provider in recovering overdue payments.

 

Space, Access, and Power Requirements

 

3.1 The client is responsible for providing a suitable setup location, approximately 3 meters deep, 3 meters wide, and 3 meters high, that is safely accessible.

3.2 Easy access to a parking area for delivery and unloading must be available.

3.3 Power outlets should be within 10 meters of the setup area and capable of supporting the photobooth’s electrical requirements.

3.4 Wi-Fi access is essential for operation and digital image transfer; the client shall ensure reliable connectivity.

3.5 For above-ground or outdoor venues, the client must ensure the presence of an elevator or proper overhead coverage, respectively, to facilitate setup and protect equipment.

 

Changes, Cancellations, and Rescheduling

 

4.1 Any request to change the event date must be submitted in writing at least 7 days prior. Changes are subject to availability.

4.2 If the requested date is unavailable, the original booking will be cancelled, and the initial deposit will be forfeited.

4.3 Cancellations made more than 7 days before the event will result in the forfeiture of the deposit only.

4.4 Cancellations or changes made within 7 days of the event may result in full charges being applicable.

4.5 Cancellations within 24 hours of the scheduled event will incur the full service fee.

 

 Operator and Equipment Safety

 

5.1 The client is responsible for ensuring a safe environment for the photo booth operator at all times.

5.2 Any threatening, aggressive, or violent behavior will not be tolerated and may result in immediate termination of the service.

5.3 The operator has the right to cease operation and leave the venue if they feel unsafe or threatened during the rental period.

5.4 If the operator leaves due to safety concerns, the client will still be liable for the full service fee.

5.5 Guests will refrain from moving or modifying any installed equipment.

 

 Damage, Loss, and Liability

 

6.1 The client is responsible for any damage or loss caused to the photo booth equipment directly by guests, staff, or the client themselves.

6.2 The client must ensure that the equipment remains in good condition throughout the rental period.

6.3 The provider shall not be responsible for any injuries or damages that occur as a result of misuse or mishandling of equipment during the rental period.

 

Outdoor and Special Conditions

 

7.1 For outdoor events, the client must provide adequate overhead coverage to protect the equipment from weather elements.

7.2 The client shall ensure the setup area is free of hazards and accessible for delivery and operation.

 

Intellectual Property

 

8.1 The provider retains ownership of all images, videos, and digital content produced during the event unless otherwise agreed in writing.

 

Indemnity and Release

 

9.1 The client agrees to indemnify and hold harmless the provider from any claims, damages, or liabilities arising from the client's negligence, misuse, or failure to follow safety instructions

 

Force Majeure

 

10.1 The provider shall not be held liable for cancellations or delays caused by circumstances beyond control, including natural disasters, technical failures, or unforeseen events.
